1. Acceptance of Terms

By visiting the Site, submitting a contact or estimate request form, or contracting with BlueStreet Kendall Sunrooms & Patios for any service, you acknowledge that you have read, understood, and agree to these Terms and Conditions and our Privacy Policy. These terms apply to all visitors, leads, clients, and others who interact with us through the Site or in connection with our services.

2. Description of Services

BlueStreet Kendall Sunrooms & Patios is a residential sunroom and outdoor enclosure contractor serving homeowners in the Miami-Dade County area. Our services include sunroom additions, four season sunrooms, three season sunrooms, patio enclosures, screen room installation, solarium installation, patio cover installation, custom sunrooms, sunroom construction, sunroom remodeling, sunroom design, vinyl sunrooms, enclosed patio rooms, all season rooms, and patio-to-sunroom and deck-to-sunroom conversions.

The information on the Site is provided for general informational purposes. Nothing on the Site constitutes a binding offer or guarantee of services, pricing, or availability. All services are subject to a written contract signed by both parties.

3. Estimates and Pricing

Free on-site estimates are offered as a courtesy and are not binding quotes. A formal written proposal will be provided after the site visit. Proposals are valid for 30 days from the date issued unless otherwise noted in writing.

Prices are subject to change based on material costs, site conditions discovered during construction, changes in project scope requested by the client, or permitting requirements imposed by Miami-Dade County or other applicable authorities. Any changes to project scope or price will be documented in a written change order signed by both parties before work continues.

We do not guarantee that the price displayed in any marketing materials or on the Site reflects current pricing for any specific project. All pricing is determined on a project-by-project basis after an on-site assessment.

4. Scheduling and Cancellation

Project scheduling is subject to availability, permit approval timelines, and weather conditions. We will communicate a projected start date after contracts are signed and permits are submitted. Project timelines are estimates and may change due to permit delays, weather, material availability, or other conditions outside our control.

If you need to cancel or postpone a scheduled project, please notify us in writing as soon as possible. Cancellation terms, including any applicable fees or deposit retention, will be specified in your written contract. In general, deposits covering permit application fees and materials already ordered are non-refundable.

5. Payment Terms

Payment terms are outlined in your written contract. Most projects require a deposit at signing, with additional progress payments tied to construction milestones, and a final payment upon completion and the client's satisfactory inspection of the work.

We accept payment by check, bank transfer, or other methods specified in your contract. We reserve the right to pause or stop work if payments are not made according to the schedule in your contract. Balances not paid within the time specified in the contract may be subject to interest charges as permitted by Florida law.

6. Permits and Compliance

All projects that legally require a building permit in Miami-Dade County will be permitted by BlueStreet Kendall Sunrooms & Patios as part of the project. We do not perform unpermitted work on projects that require a permit by law. The client is responsible for ensuring that any applicable HOA approvals are obtained before construction begins.

7. Warranty Disclaimers

Any workmanship warranty we provide will be stated in your written contract. General warranty terms for residential construction in Florida are governed by applicable state law.

The Site and all content on it are provided "as is" without warranties of any kind, express or implied. We make no warranties regarding the accuracy, completeness, or suitability of information on the Site for any particular purpose.

Manufacturer warranties on materials, glass, windows, and other components are passed through to the client to the extent they are assignable. We do not extend manufacturer warranties beyond what is provided by the manufacturer.

8. Limitation of Liability

To the fullest extent permitted by applicable law, BlueStreet Kendall Sunrooms & Patios shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or our services, including but not limited to loss of profits, loss of use, or property damage beyond the direct scope of our work.

Our total liability to you for any claim arising from our services shall not exceed the amount you paid to us for the specific project giving rise to the claim.

9. Dispute Resolution

If a dispute arises between you and BlueStreet Kendall Sunrooms & Patios related to our services or these terms, both parties agree to first attempt to resolve it informally by contacting us at contact@kendallsunroomsandpatios.com. We will make a good-faith effort to address your concern within 15 business days.

If informal resolution is not successful, disputes shall be resolved through binding arbitration or in a court of competent jurisdiction in Miami-Dade County, Florida, as specified in your written contract.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action arising under these terms shall be brought in the appropriate courts located in Miami-Dade County, Florida.

11. Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the Site. You may not use the Site to transmit any harmful, offensive, or fraudulent content. We reserve the right to restrict access to the Site for any reason without notice.

All content on the Site - including text, images, logos, and design - is the property of BlueStreet Kendall Sunrooms & Patios or its content suppliers and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our written permission.
